Service Standards
We strive to maintain high service standards and system availability. However, we do not guarantee uninterrupted or error-free operation. Scheduled maintenance, updates, and unforeseen technical issues may impact service availability. We will provide reasonable notice of scheduled maintenance and work diligently to minimize any service disruptions.
Client Responsibilities
Usage Requirements
Clients must use our services in accordance with provided guidelines and training. This includes maintaining appropriate safety protocols, ensuring proper environmental conditions for robot operation, and following recommended maintenance procedures. Unauthorized modification or misuse of our robotics solutions is strictly prohibited.
Staff Training
Clients are responsible for ensuring their staff complete required training programs and follow operational guidelines. This includes maintaining trained personnel for robot supervision, understanding emergency procedures, and proper handling of guest interactions involving our robotics solutions.
Liability and Warranty
Limited Warranty
We warrant that our services will perform substantially in accordance with our specifications. This warranty is limited to the repair or replacement of defective components and does not cover damage resulting from misuse, unauthorized modification, or failure to follow operating instructions.
Limitation of Liability
To the maximum extent permitted by law, Explora shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our services. Our total liability for any claims shall not exceed the amounts paid for the specific service giving rise to the claim.
Intellectual Property
Ownership Rights
All intellectual property rights in our robotics solutions, software, and services remain the exclusive property of Explora. This includes patents, trademarks, copyrights, trade secrets, and other proprietary rights. Clients receive a limited license to use our services as intended and may not reverse engineer, decompile, or attempt to extract our source code.
Data Rights
While clients retain ownership of their business data, we maintain the right to collect and analyze usage data to improve our services. This includes robot performance metrics, service patterns, and operational statistics. We may use anonymized data for research, optimization, and product development purposes.
Term and Termination
Duration
These Terms remain in effect for the duration of your use of our services. Service agreements may specify additional term lengths and renewal conditions. Either party may terminate the agreement for material breach with reasonable notice and opportunity to cure.
Post-Termination
Upon termination, clients must cease use of our services and return all equipment in accordance with our return procedures. We will assist in the orderly transition of services and provide reasonable access to stored data. Provisions relating to intellectual property, confidentiality, and liability survive termination.
